Understanding Martyn's Law: Implications for Venues and Educational Establishments

The Terrorism (Protection of Premises) Bill, known as Martyn’s Law, represents a pivotal step in enhancing public safety. Introduced to Parliament on 12 September 2024, it mandates a tiered approach to protective security and preparedness against terrorist threats, such as venues and educational establishments. 

Key Requirements for Venues and Educational Institutions

If passed, the bill applies to premises that host large groups of people. Specifically, venues hosting between 200-799 individuals fall under the standard tier, requiring them to establish basic public protection procedures, such as monitoring for suspicious behaviour and controlling movement within the premises. Larger premises such as stadiums, with a capacity of over 800 persons, move to the enhanced tier. These establishments must implement more sophisticated measures, such as CCTV systems, Access Control, Public Address Voice Alarm (PA/VA), and even physical security measures like barriers. 

Educational establishments that host 200 or more individuals will fall under the standard tier. These premises will not be subject to the enhanced tier requirements, regardless of size. However, they must implement appropriate public protection procedures, including evacuation, lockdown, and communication processes, to ensure safety during potential threats.  

Fines and Penalties for Non-Compliance 

Failure to comply with the bill's requirements can result in serious consequences. The Security Industry Authority (SIA) is empowered to conduct inspections, gather information, and issue compliance or restriction notices. Persistent non-compliance can lead to significant fines of up to £18 million or even criminal charges, particularly for those in charge of premises in the enhanced tier. Penalty notices will be issued for breaches, especially if there is evidence of neglect or misrepresentation during compliance checks.
